Al-Mubarat (disavowing) or Divorce for Payment
أَبُو عَلِيٍّ الْأَشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ وَ مُحَمَّدُ بْنُ إِسْمَاعِيلَ عَنِ الْفَضْلِ بْنِ شَاذَانَ وَ أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ جَعْفَرٍ عَنْ أَيُّوبَ بْنِ نُوحٍ وَ حُمَيْدُ بْنُ زِيَادٍ عَنِ ابْنِ سَمَاعَةَ جَمِيعاً عَنْ سُفْيَانَ عَنِ ابْنِ مُسْكَانَ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ الْمُبَارَاةُ تَقُولُ الْمَرْأَةُ لِزَوْجِهَا لَكَ مَا عَلَيْكَ وَ اتْرُكْنِي أَوْ تَجْعَلُ لَهُ مِنْ قِبَلِهَا شَيْئاً فَيَتْرُكُهَا إِلَّا أَنَّهُ يَقُولُ فَإِنِ ارْتَجَعْتِ فِي شَيْءٍ فَأَنَا أَمْلَكُ بِبُضْعِكِ وَ لَا يَحِلُّ لِزَوْجِهَا أَنْ يَأْخُذَ مِنْهَا إِلَّا الْمَهْرَ فَمَا دُونَهُ .
5. Abu Ali al-Ash‘ariy has narrated from Muhammad ibn ‘Abd al-Jabbar and Muhammad ibn ’Isma‘il has narrated from al-Fadl ibn Shadhan from and abu al-‘Abbas from Muhammad ibn Ja‘far from Ayyub ibn Nuh and Humayd ibn Ziyad has narrated from ibn Sama‘ah all from Sufyan from ibn Muskan from abu Basir who has said the following: “Abu ‘Abd Allah (a.s.), has said that al-Mubarat (disavowing) takes place when a woman says to her husband, ‘Whatever you owe to me is for you and set me free (from the bond of marriage).’ Or she pays extra from her side so he sets her free, except that he can say that if she goes back in anything, then he will be more rightful to have her as his wife. It is not lawful for her husband to take more than what is equal to her mahr (dower) or less.’”
حُمَيْدُ بْنُ زِيَادٍ عَنِ ابْنِ سَمَاعَةَ عَنْ مُحَمَّدِ بْنِ زِيَادٍ عَنْ عَبْدِ اللَّهِ بْنِ سِنَانٍ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ الْمُبَارِئَةُ تَقُولُ لِزَوْجِهَا لَكَ مَا عَلَيْكَ وَ بَارِئْنِي وَ يَتْرُكُهَا قَالَ قُلْتُ فَيَقُولُ لَهَا فَإِنِ ارْتَجَعْتِ فِي شَيْءٍ فَأَنَا أَمْلَكُ بِبُضْعِكِ قَالَ نَعَمْ .
6. Humayd ibn Ziyad has narrated from ibn Sama‘ah from Muhammad ibn Ziyad from ‘Abd Allah ibn Sinan who has said the following: “Abu ‘Abd Allah (a.s.), has said that in al-Mubarat (disavowing) a woman says to her husband, ’You can have whatever you owe to me and free me (from the bonds of marriage). He then sets her free (from the bonds of marriage).’ I (the narrator) then asked, ’Will he then say to her, "If you demand anything back then I will have more right than anyone else to have you as my wife”?’ He (the Imam) said, ‘Yes, he can say so.’”
مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ قَالَ سَأَلْتُ أَبَا الْحَسَنِ الرِّضَا ( عليه السلام ) عَنِ الْمَرْأَةِ تُبَارِئُ زَوْجَهَا أَوْ تَخْتَلِعُ مِنْهُ بِشَاهِدَيْنِ عَلَى طُهْرٍ مِنْ غَيْرِ جِمَاعٍ هَلْ تَبِينُ مِنْهُ فَقَالَ إِذَا كَانَ ذَلِكَ عَلَى مَا ذَكَرْتَ فَنَعَمْ قَالَ قُلْتُ قَدْ رُوِيَ لَنَا أَنَّهَا لَا تَبِينُ مِنْهُ حَتَّى يَتْبَعَهَا الطَّلَاقُ قَالَ فَلَيْسَ ذَلِكَ إِذاً خُلْعاً فَقُلْتُ تَبِينُ مِنْهُ قَالَ نَعَمْ .
7. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ’Isma‘il who has said the following: “I once asked al-Rida’ (a.s.), about the case of a woman who arranges al-Mubarat (disavowing) or al-Khul ‘ in the presence of two witnesses, in a Hayd (menses)-free period and without sexual intercourse; if she becomes stranger to him. He (the Imam) said, ’Yes, if it happens as you said has happened.’ I then said, ‘It is narrated to us that it does not make them to become stranger until it is followed by divorce.’ He (the Imam) said, ‘It then is not al-KhuV.’ I then asked, ‘Does it make her to become stranger to him?’ He said, ‘Yes, that is what it does.’”
مُحَمَّدُ بْنُ إِسْمَاعِيلَ عَنِ الْفَضْلِ بْنِ شَاذَانَ وَ أَبُو عَلِيٍّ الْأَشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ جَمِيعاً عَنْ صَفْوَانَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْحَجَّاجِ قَالَ سَأَلْتُ أَبَا عَبْدِ اللَّهِ ( عليه السلام ) هَلْ يَكُونُ خُلْعٌ أَوْ مُبَارَاةٌ إِلَّا بِطُهْرٍ فَقَالَ لَا يَكُونُ إِلَّا بِطُهْرٍ .
8. Muhammad ibn ’Isma‘il has narrated from al-Fadl ibn Shadhan and Abu Ali al-Ash‘ariy has narrated from Muhammad ibn ‘Abd al- Jabbar all from Safwan from ‘Abd al-Rahman ibn al-Hajj aj who has said the following: “I once asked abu ‘Abd Allah (a.s.), if al-Mubarat (disavowing) or al-Khul‘ can take place without Hayd (menses)-free period. He (the Imam) said, ‘It cannot take place without Hayd (menses)- free period.’”
صَفْوَانُ عَنْ عَبْدِ اللَّهِ بْنِ مُسْكَانَ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ ( عليه السلام ) وَ صَفْوَانُ عَنْ عَنْبَسَةَ بْنِ مُصْعَبٍ عَنْ سَمَاعَةَ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ لَا يَكُونُ طَلَاقٌ وَ لَا تَخْيِيرٌ وَ لَا مُبَارَاةٌ إِلَّا عَلَى طُهْرٍ مِنْ غَيْرِ جِمَاعٍ بِشُهُودٍ .
9. Safwan has narrated from ‘Abd Allah ibn Muskan from Muhammad ibn Muslim from abu Ja‘far (a.s.), and Safwan from ‘Anbasah ibn Mus’ab from Sama‘ah who has said the following: “Abu ‘Abd Allah (a.s.), has said that no divorce, choice or al-Mubarat (disavowing) can take place without Hayd (menses)-free period, free from sexual intercourse and without the presence of witnesses.’”
مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنِ الْعَلَاءِ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ ( عليه السلام ) قَالَ قَالَ لَا طَلَاقَ وَ لَا خُلْعَ وَ لَا مُبَارَاةَ وَ لَا خِيَارَ إِلَّا عَلَى طُهْرٍ مِنْ غَيْرِ جِمَاعٍ .
10. Muhammad ibn Yahya Ahmad ibn Muhammad from Ali ibn al-Hakam from al-‘Ala’ from Muhammad ibn Muslim who has said the following: “Abu Ja’far (a.s.), has said, ‘Divorce, al-Khul‘ , al-Mubarat (disavowing) and choice are only valid during a Hayd (menses)-free period in which sexual intercourse has not happened.’”

Waiting Period for al-KhuP and al-Mubarat (disavowing), the Maintenance and Housing for such Women
عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ عَنْ عَبْدِ الْكَرِيمِ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ عِدَّةُ الْمُخْتَلِعَةِ مِثْلُ عِدَّةِ الْمُطَلَّقَةِ وَ خُلْعُهَا طَلَاقُهَا .
1. A number of our people have narrated from Sahl ibn Ziyad from Ahmad ibn Muhammad from ibn abu Nasr from ‘Abd al-Karim from ibn abu Nasr who has said the following: “Abu ‘Abd Allah (a.s.), has said that waiting period for al-Khul‘ is like the waiting period for divorced woman and al-Khul‘ is her divorce.’”
وَ بِإِسْنَادِهِ عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَبْدِ الْكَرِيمِ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ لَا تُمَتَّعُ الْمُخْتَلِعَةُ .
2. Through the same chain of narrators as that of the previous Hadith the following is narrated Ahmad ibn Muhammad from ‘Abd al- Karim from al-Halabiy who has said the following: “Abu ‘Abd Allah (a.s.), has said that a woman because of al-Khul‘ does not receive any benefit.’”
عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ قَالَ الْمُخْتَلِعَةُ لَا تُمَتَّعُ .
3. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “He (the Imam) ‘Alayhi al-Salam, has said that woman of al-Khul‘ does not receive any benefits.’”
الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ مُعَلَّى بْنِ مُحَمَّدٍ عَنِ الْحَسَنِ بْنِ عَلِيٍّ الْوَشَّاءِ عَنْ أَبَانٍ عَنْ زُرَارَةَ قَالَ سَأَلْتُ أَبَا جَعْفَرٍ ( عليه السلام ) عَنْ عِدَّةِ الْمُخْتَلِعَةِ كَمْ هِيَ قَالَ عِدَّةُ الْمُطَلَّقَةِ وَ لْتَعْتَدَّ فِي بَيْتِهَا وَ الْمُبَارِئَةُ بِمَنْزِلَةِ الْمُخْتَلِعَةِ .
4. Al-Husayn from Muhammad has narrated from Mu‘alla’ ibn Muhammad from al-Hassan ibn Ali al-Washsha’ from Aban from Zurarah who has said the following: “I once asked abu Ja‘far (a.s.), about the waiting period of a woman in al-Khul‘. He (the Imam) said, ‘It is like the waiting period of a divorced woman and she must complete her waiting period in her home and a woman in al-Mubarat (disavowing) is the same as the one in al-Khul‘.’”
