Separation of Slaves from their Relatives (Is Not Permissible)

781. hadíth Majlisī: صحيح

5- مُحَمَّدٌ عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ الْحُسَيْنِ بْنِ سَعِيدٍ عَنِ النَّضْرِ بْنِ سُوَيْدٍ عَنِ ابْنِ سِنَانٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) أَنَّهُ قَالَ فِي الرَّجُلِ يَشْتَرِي الْغُلامَ أَوِ الْجَارِيَةَ وَلَهُ أَخٌ أَوْ أُخْتٌ أَوْ أَبٌ أَوْ أُمٌّ بِمِصْرٍ مِنَ الأمْصَارِ قَالَ لا يُخْرِجْهُ إِلَى مِصْرٍ آخَرَ إِنْ كَانَ صَغِيراً وَلا يَشْتَرِهِ فَإِنْ كَانَتْ لَهُ أُمٌّ فَطَابَتْ نَفْسُهَا وَنَفْسُهُ فَاشْتَرِهِ إِنْ شِئْتَ.

5. Muhammad has narrated from Ahmad ibn Muhammad from al-Husayn ibn Sa‘id from al-Nadr ibn Suwayd from ibn Sinan from abu 'Abdillah (AS) who said: “Regarding a man who buys a slave-girl or a slave boy who has a brother or sister, or a father or mother in a city of the cities, he must not take such slave out of that city to another city if the slave is a minor, and must not buy such slaves but if the slave has a mother who agrees as well as the slave, then you can buy.”

782. hadíth Majlisī: ضعيف على المشهور

1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ مُوسَى بْنِ بَكْرٍ عَنِ الْفُضَيْلِ قَالَ قَالَ غُلامٌ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) إِنِّي كُنْتُ قُلْتُ لِمَوْلايَ بِعْنِي بِسَبْعِمِائَةِ دِرْهَمٍ وَأَنَا أُعْطِيكَ ثَلاثَمِائَةِ دِرْهَمٍ فَقَالَ لَهُ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) إِنْ كَانَ لَكَ يَوْمَ شَرَطْتَ أَنْ تُعْطِيَهُ شَيْ‏ءٌ فَعَلَيْكَ أَنْ تُعْطِيَهُ وَإِنْ لَمْ يَكُنْ لَكَ يَوْمَئِذٍ شَيْ‏ءٌ فَلَيْسَ عَلَيْكَ شَيْ‏ءٌ.

1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Musa ibn Bakr from al-Fudayl who has said the following: “Once, a slave said to abu ‘ Abd Allah (a.s.), ‘I had said to my master, “Sell me for seven hundred dirham, I pay you three hundred dirham.’” Abu ‘Abd Allah (a.s.), said, ‘If you owned something on the day you made the condition then you must pay, and if you did not have anything on that day, there is nothing on you.’”

783. hadíth Majlisī: ضعيف على المشهور

2- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ فُضَيْلٍ قَالَ قَالَ غُلامٌ سِنْدِيٌّ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) إِنِّي قُلْتُ لِمَوْلايَ بِعْنِي بِسَبْعِمِائَةِ دِرْهَمٍ وَأَنَا أُعْطِيكَ ثَلاثَمِائَةِ دِرْهَمٍ فَقَالَ لَهُ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) إِنْ كَانَ يَوْمَ شَرَطْتَ لَكَ مَالٌ فَعَلَيْكَ أَنْ تُعْطِيَهُ وَإِنْ لَمْ يَكُنْ لَكَ يَوْمَئِذٍ مَالٌ فَلَيْسَ عَلَيْكَ شَيْ‏ءٌ.

2. A number of our people have narrated from Sahl ibn Ziyad from ibn Mahbub from Fudayl who has said the following: “A Sindiy slave once said to abu ‘Abd Allah (a.s.), ‘I said to my master, “Sell me for seven hundred dirham, I pay you three hundred dirham.’” Abu ‘Abd Allah (a.s.), said, ‘If you owned something on the day you made the condition then you must pay, and if you did not have anything on that day there is nothing on you.’”

Advance Payment for Buying Slaves and Animals

784. hadíth Majlisī: ضعيف على المشهور

1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ عَلِيِّ بْنِ أَبِي حَمْزَةَ عَنْ أَبِي بَصِيرٍ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنِ السَّلَمِ فِي الْحَيَوَانِ قَالَ لَيْسَ بِهِ بَأْسٌ قُلْتُ أَرَأَيْتَ إِنْ أَسْلَمَ فِي أَسْنَانٍ مَعْلُومَةٍ أَوْ شَيْ‏ءٍ مَعْلُومٍ مِنَ الرَّقِيقِ فَأَعْطَاهُ دُونَ شَرْطِهِ وَفَوْقَهُ بِطِيبَةِ أَنْفُسٍ مِنْهُمْ فَقَالَ لا بَأْسَ بِهِ.

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Ali ibn abu Hamzah from abu Basir who has said the following: “This is concerning my question before abu ‘ Abd Allah (a.s.), about the case of advance payment in buying animals. He (the Imam) said, ‘It is not unlawful.’ I then asked him (the Imam) if I can make an advance payment for known years or something known like slaves and I pay more or less than his stipulation with consent and happiness. He (the Imam) said, ‘It is not unlawful.’”

785. hadíth Majlisī: حسن

2- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي نَجْرَانَ عَنْ عَاصِمِ بْنِ حُمَيْدٍ عَنْ مُحَمَّدِ بْنِ قَيْسٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ قَالَ أَمِيرُ الْمُؤْمِنِينَ (عَلَيْهِ السَّلام) فِي رَجُلٍ أَعْطَى رَجُلا وَرِقاً فِي وَصِيفٍ إِلَى أَجَلٍ مُسَمًّى فَقَالَ لَهُ صَاحِبُهُ لا نَجِدُ لَكَ وَصِيفاً خُذْ مِنِّي قِيمَةَ وَصِيفِكَ الْيَوْمَ وَرِقاً قَالَ فَقَالَ لا يَأْخُذُ إِلا وَصِيفَهُ أَوْ وَرِقَهُ الَّذِي أَعْطَاهُ أَوَّلَ مَرَّةٍ لا يَزْدَادُ عَلَيْهِ شَيْئاً.

2. Ali ibn Ibrahim has narrated from his father from ‘Abd al-Rahman ibn abu Najran from ‘Asim ibn Hamid from Muhammad ibn Qays who has said the following: “Abu Ja‘far (a.s.), has said that ’Amir al-Mu’minin, about the case of a man who gave a note to another man for a servant for an appointed time and his party said, ‘I could not find a servant for you, you take from me the cost of your servant today in the form of the value.’ He (’Amir al- Mu’minin) has said, ‘He can refuse to take anything other than his servant or the note that he had given him at first without any thing added.’”

786. hadíth Majlisī: حسن

3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ جَمِيلِ بْنِ دَرَّاجٍ عَنْ زُرَارَةَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ لا بَأْسَ بِالسَّلَمِ فِي الْحَيَوَانِ إِذَا وُصِفَتْ أَسْنَانُهَا.

3. Ali ibn Ibrahim has narrated from his father from ibn abu ‘ Umayr from Jamil ibn Darraj from Zurarah who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘Advance payment to buy an animal is not unlawful if the age of animals is clearly described.’”

787. hadíth Majlisī: موثق كالصحيح

4- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ فَضَّالٍ عَنِ ابْنِ بُكَيْرٍ عَنْ عُبَيْدِ بْنِ زُرَارَةَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ لا بَأْسَ بِالسَّلَمِ فِي الْحَيَوَانِ إِذَا سَمَّيْتَ شَيْئاً مَعْلُوماً.

4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Faddal from ibn Bukayr from ‘Ubayd ibn Zurarah who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘Advance payment to buy an animals is not unlawful if it (the animal) is clearly made known.’”

788. hadíth Majlisī: صحيح على الظاهر

5- أَحْمَدُ بْنُ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ سَيْفِ بْنِ عَمِيرَةَ عَنْ أَبِي مَرْيَمَ الأنْصَارِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) أَنَّ أَبَاهُ لَمْ يَكُنْ يَرَى بَأْساً بِالسَّلَمِ فِي الْحَيَوَانِ بِشَيْ‏ءٍ مَعْلُومٍ إِلَى أَجَلٍ مَعْلُومٍ.

5. Ahmad ibn Muhammad has narrated from Ali ibn al-Hakam from Sayf ibn ‘Amirah from abu Maryam al-Ansariy who has said the following: “Abu ‘Abd Allah (a.s.), has said that his father would not consider advance payment to buy an animal unlawful for a clearly known merchandise and time.”

789. hadíth Majlisī: صحيح

6- أَحْمَدُ بْنُ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ قُتَيْبَةَ الأعْشَى عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي الرَّجُلِ يُسْلِمُ فِي أَسْنَانٍ مِنَ الْغَنَمِ مَعْلُومَةٍ إِلَى أَجَلٍ مَعْلُومٍ فَيُعْطِي الرَّبَاعَ مَكَانَ الثَّنِيِّ فَقَالَ أَلَيْسَ يُسْلِمُ فِي أَسْنَانٍ مَعْلُومَةٍ إِلَى أَجَلٍ مَعْلُومٍ قُلْتُ بَلَى قَالَ لا بَأْسَ.

6. Ahmad ibn Muhammad from has narrated from Ali ibn al-Hakam from Qutaybah al-‘A’sha’ who has said the following: “About the case of a man who makes advance payment for sheep of a certain age for an appointed time and the party gives him four years old in place of three years old, abu ‘Abd Allah (a.s.), asked, ‘Is it not true that he has made advance payment for (animals of) known age and on an appointed time? I replied, ‘Yes, that is true.’ He (the Imam) said, ‘It is not unlawful.’”

790. hadíth Majlisī: صحيح

7- أَحْمَدُ بْنُ مُحَمَّدٍ وَعَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ جَمِيعاً عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ أَبِي الْمَغْرَاءِ عَنِ الْحَلَبِيِّ قَالَ سُئِلَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنِ الرَّجُلِ يُسْلِمُ فِي وُصَفَاءِ أَسْنَانٍ مَعْلُومَةٍ وَلَوْنٍ مَعْلُومٍ ثُمَّ يُعْطِي دُونَ شَرْطِهِ أَوْ فَوْقَهُ فَقَالَ إِذَا كَانَ عَنْ طِيبَةِ نَفْسٍ مِنْكَ وَمِنْهُ فَلا بَأْسَ.

7. Ahmad ibn Muhammad from and Ali has narrated from his father all from Ibn Abi ‘Umayr from abu al-Mighra’ from al-Halabiy who has said the following: “Once abu ‘Abd Allah (a.s.), was asked about the case of a man who made an advance payment for things of clearly described age and color; then the party gave him more or less than the set condition. He (the Imam) said, ‘If it is with fine consent it is not unlawful.’”
