وما ينقض الوضوء ينقض التيمم، والنظر إلى الماء ينقض التيمم، ومن تيمم وصلى ثم وجد الماء وهو في وقت الصلاة، أو قد خرج الوقت، فلا إعادة عليه، لان التيمم أحد الطهورين، فليتوضأ لصلاة أخرى، ولا بأس أن يصلي الرجل بوضوء واحد صلاة الليل والنهار كلاهما لم يحدث، وكذلك للمتيمم ما لم يحدث أو يصب ماء.
Whatever breaks the wudu breaks the tayammum. Looking at water breaks the tayammum. Someone who did tayammum and prayed, then found water while he is [still] in the time of prayer or has exited the time, then there is no repetition [of the prayer] upon him, for the tayammum is one of the two purifications. So, he is to do wudu for another prayer. There is no harm that the man should pray all of the prayer of the night and day with a single wudu so long as did not have a hadath (something that breaks the wudu). Likewise is the person with tayammum so long as he did not have a hadath or come upon water.
والغسل في سبعة عشر موطنا: غسل ليلة سبع عشرة من شهر رمضان، وليلة تسع عشرة، وليلة إحدى وعشرين، وليلة ثلاث وعشرين، وللعيدين، وعند دخول الحرمين، وعند الاحرام، وغسل الزيارة، وغسل الدخول إلى البيت، ويوم التروية، ويوم عرفة، وغسل الميت، وغسل من غسل ميتا أو كفنه أو مسه بعد ما يبرد، وغسل يوم الجمعة، وغسل الكسوف إذا احترق القرص كله ولم يعلم به الرجل، وغسل الجنابة فريضة، وكذلك غسل الحيض، لان الصادق (عليه السلام) قال: (غسل الجنابة والحيض واحد)، وكل غسل فيه وضوء في أوله إلا غسل الجنابة، لانه فريضة، وإذا اجتمع فرضان فأكبرهما يجزي عن أصغر هما.
And the ghusl is in seventeen places: the ghusl of the seventeenth night of the month of Ramadan, and the nineteenth night, the twenty first night, and the twenty third night, and for the two Eids, for entering the two Sanctuaries, for donning ihram, the ghusl of ziyara, the ghusl of entering the House, the day of Tarwiya, the day of `Arafa, the ghusl of the deceased, the ghusl of the one who gave the ghusl of the deceased or did his kafan or touched him after he became cold, the ghusl of day of Jum`a, the ghusl of the eclipse – when the disc has been entirely eclipsed (lit. burnt) and the man did not know it – and the ghusl of janaba is an obligation (farida), and likewise is the ghusl of menstruation (al-hayd) for al-Sadiq (as) said: The ghusl of janaba and hayd is one. In every ghusl there is a wudu in its beginning except for the ghusl of janaba, for it is an obligation and when two obligations (fardan) convene then the greater of them suffices for the lesser of them.
ومن أراد الغسل من الجنابة فليجتهد أن يبول ليخرج ما بقي في إحليله من المني، ثم يغسل يديه ثلاثا من قبل أن يدخلهما الاناء، ثم يستنجي وينقي فرجه، ثم يضع على رأسه ثلاث أكف من الماء، ويميز الشعر بأنامله حتى يبلغ الماء أصل الشعر كله، ثم يتناول الاناء بيده ويصبه على رأسه وبدنه مرتين، ويمر يده على بدنه كله، ويخلل اذنيه بإصبعيه، وكل من أصابه الماء فقد طهر، وإذا ارتمس الجنب في الماء ارتماسة واحدة أجزأه ذلك من غسله، وإن قام في المطر حتى يغسله فقد أجزاه ذلك من غسله، ومن أحب أن يتمضمض ويستنشق في غسل الجنابة فليفعل، وليس ذلك بواجب لان الغسل على ما ظهر لا على ما بطن، غير أنه إذا أراد أن يأكل أو يشرب قبل الغسل لم يجز له إلا أن يغسل يديه ويتمضمض ويستنشق، فإنه إن أكل أو شرب قبل ذلك خيف عليه البرص، وإذا عرق الجنب في ثوبه، وكانت الجنابة من حلال، فحلال الصلاة في الثوب، وإن كانت من حرام فحرام الصلاة فيه.
Someone who wants to do ghusl from janaba is to make an effort to urinate so that whatever is left in his urethra of semen exits out. Then, he washes his hands thrice before entering them into the vessel. Then, he does istinja and cleanses his private. Then, he puts three handfuls of water on his head, and separates his hair with his fingertips until the water reaches the root of all of his hair. Then, he takes the vessels with his hand and pours it on his head and his body twice, and passes his hand on all of his body, and runs his finger through his ears. All that the water comes in contact with is thus purified. When the junub immerses [himself] in water with a single (complete) immersion, that suffices him for his ghusl. When he stands in the rain until it washes him, that suffices him for his ghusl. Whoever likes to do the mouth-rinsing and to do the nose-rinsing in the ghusl of janaba then he is to do so, but that is not obligatory as the ghusl is upon what is on the outside, not upon what is on the inside, except that when he wants to eat or drink prior to the ghusl it is not permissible for him unless he washes his hands and rinses his mouth and nose, for al-baras is feared for him if he eats or drinks prior to that. When the junub sweats in his garment, and the janaba from a halal [intercourse], then prayer is halal in the garment. However, if it was from a haram [intercourse], then prayer is haram in it.
وأقل الحيض ثلاثة أيام، وأكثرها عشرة أيام، وأقل الطهر عشرة أيام، وأكثره لا حد له، وأكثر أيام النفساء التي تقعد فيها عن الصلاة ثمانية عشر يوما، وتستظهر بيوم أو يومين إلا أن تطهر قبل ذلك.
The least number of days of menstruation (al-hayd) is three, and the maximum of it is ten days. The least number of purity is ten days, and its maximum has no limit. The maximum number of days of the woman in post-partum bleeding (al-nafsaa) in which she refrains from prayer is eighteen days, and she waits a day or two unless she is purified prior to that.
والزكاة على تسعة أشياء: على الحنطة، والشعير، والتمر، والزبيب، والابل، والبقر، والغنم، والذهب، والفضة، وعفا رسول الله (صلى الله عليه وآله) عما سوى ذلك، ولا يجوز دفع الزكاة إلا إلى أهل الولاية، ولا يعطى من أهل الولاية الابوان والولد والزوج والزوجة والمملوك وكل من يجبر الرجل على نفقته.
Zakat is upon nine things: upon wheat, barley, dates, raisins, camels, cattle, sheep, gold and silver, and the Messenger of Allah (s) pardoned what was apart from that. It is not permissible to pay the zakat to anyone other than the people of walaya. From the people of walaya it is not permissible to give to one’s parents, one’s child, one’s husband, one’s wife, one’s slave and anyone for whose expense the man is obliged.
والخمس واجب في كل شئ بلغ قيمته دينارا، من الكنوز، والمعادن، والغوص، والغنيمة، وهو الله عز وجل، ولرسوله (صلى الله عليه وآله)، ولذي القربى من الاغنياء والفقراء، واليتامى، والمساكين، وابن السبيل من أهل الدين. وصيام السنة ثلاثة أيام في كل شهر: خميس في أوله، وأربعاء في وسطه، وخميس في آخره، وصيام شهر رمضان فريضة وهو بالرؤية، وليس بالرأي ولا بالتظني، ومن صام قبل الرؤية أو أفطر قبل الروية فهو مخالف لدين الامامية، ولا تقبل شهادة النساء في الطلاق، ولا في رؤية الهلال. والصلاة في شهر رمضان كالصلاة في غيره من الشهور، فمن أحب أن يزيد فليصل كل ليلة عشرين ركعة، ثماني ركعات بين المغرب والعشاء الآخرة، واثنتي عشرة ركعة بعد العشاء الآخرة إلى أن تمضي عشرون ليلة من شهر رمضان، ثم يصلي كل ليلة ثلاثين ركعة، ثمان ركعات منها بين المغرب والعشاء، واثنتين وعشرين ركعة بعد العشاء، ويقرأ في كل ركعة منها الحمد وما تيسر له من القرآن، إلا في ليلة إحدى وعشرين وليلة ثلاث وعشرين، فإنه يستحب إحياؤهما، وأن يصلي الانسان في كل ليلة منهما مائة ركعة، يقرأ في كل ركعة الحمد مرة و (قل هو الله أحد) عشر مرات، ومن أحيا هاتين الليلتين بمذاكرة العلم فهو أفضل.
The khums is obligatory in everything that reaches a gold coin in value from treasure, metals/minerals, diving, and profit/spoils (al-ghanima). It is for Allah, for His Messenger (s), and for the near kin from the well-off and the poor, and the orphans, and the needy, and the traveler from the people of the religion. Fasting three days per month is equivalent to fasting for the full year: a Thursday in the beginning, a Wednesday in the middle, and a Thursday in its end. Fasting the month of Ramadan is obligatory, and it is [initiated] through sighting [of the Moon] rather than through opinion or thought. He who fasts before the sighting or breaks his fast before the sighting has opposed the religion of the Imamiyya. The witnessing of women is not accepted in divorce, nor in sighting the crescent. Prayer in the month of Ramadan is the same as prayer in other months. Whoever would like to increase should pray twenty units every night: eight units between Maghrib and the final `Isha’, and twelve units after the final `Isha until twenty nights of the month of Ramadan have passed. Then, one prays thirty units per night: eight units between Maghrib and `Isha’, and twenty-two units after `Isha’. In each unit, one recites al-Hamd and whatever he would like from the Quran; except on the night of the twenty first and the twenty third. It is recommended to keep vigil in them and to pray one hundred units in each night. In each unit, one recites al-Hamd once and qul huwallahu ahad ten times. Whoever spends these two nights reviewing knowledge, it is better.
وينبغي للرجل إذا كان ليلة الفطر أن يصلي المغرب ثلاثا، ثم يسجد ويقول في سجوده: يا ذا الطول، يا ذا الحول، يا مصطفي محمد وناصره، صل على محمد وآل محمد، واغفر لي كل ذنب أذنبته ونسيته وهو عندك في كتاب مبين، ثم يقول مائة مرة: أتوب إلى الله عز وجل. ويكبر بعد المغرب والعشاء الآخرة وصلاة الغداة والعيد والظهر والعصر كما يكبر أيام التشريق، يقول: الله أكبر، الله أكبر، لا إله إلا الله، والله أكبر، الله أكبر ولله الحمد، الله أكبر على ما هدانا، والحمد لله على ما أبلانا، ولا يقول فيه: ورزقنا من بهيمة الانعام، فإن ذلك في أيام التشريق.
One the eve of al-Fitr, a man should pray the three [units of] Maghrib, then perform a sujud, then say in his sujud: ya dhal tawl, ya dhal hawl, ya mustafi Muhammad wa nasirah, salli `ala muhammadan wa alih Muhammad, waghfir li kulli dhanbin adhnabtahu wa nasitah, wa huwa `indika fi kitabin mubin (O Patient and Powerful [God]! O Him who chose Muhammad and supported him! Bless Muhammad and the Family of Muhammad, and forgive me for every sin that I remember and that I have forgotten; and [they are all] with You in a Clear Book). Then, he should say one hundred times: atubu illallah `azza wa jal (I repent to Allah, Glorious and Majestic). Then, he should do takbir after Maghrib, the final `Isha’, the morning prayer, the Eid prayer, Thuhr, and `Asr just as he does takbir on the days of tashriq, saying: Allahu akbar, Allahu akbar, la ilaha illallah, wallahu akbar, Allahu akbar, wa lillahil hamd. Allahu akbar `ala ma hadana, walhamdu lillah `ala ma ablana (Allah is the greatest, Allah is the greatest. There is no god but Allah. Allah is the greatest, Allah is the greatest. All praise is due to Allah. Allah is greatest upon what He guided us to. Praise be to Allah upon what He taught us). He should not say therein: warzuqna min bahimat al-an`am (and grant us from the beasts of livestock), for that is only for the days of tashriq.
وزكاة الفطرة واجبة تجب على الرجل أن يخرجها عن نفسه وعن كل من يعول من صغير وكبير وحر وعبد وذكر وأنثى، صاعا من تمر، أو صاعا من زبيب، أو صاعا من بر، أو صاعا من شعير، وأفضل ذلك التمر، والصاع أربعة أمداد، والمد وزن مائتين واثنين وتسعين درهما ونصف، يكون ذلك ألف ومائة وسبعون درهما بالعراقي (1)، ولا بأس بأن يدفع قيمته ذهبا أو ورقا، ولا بأس بأن يدفع عن نفسه وعن من يعول إلى واحد، ولا يجوز أن يدفع ما يلزم واحدا إلى نفسين، ولا بأس بإخراج الفطرة في أول يوم من شهر رمضان إلى آخره، وهي زكاة إلى أن يصلي العيد، فإن أخرجها بعد الصلاة فهي صدقة، وأفضل وقتها آخر يوم من شهر رمضان، ومن كان له مملوك مسلم أو ذمي فليدفع عنه الفطرة، ومن ولد له مولود يوم الفطر قبل الزوال فليدفع عنه الفطرة، وإن ولد بعد الزوال فلا فطرة عليه، وكذلك إذا أسلم الرجل قبل الزوال وبعده، فعلى هذا.
The zakat al-fitr is obligatory for every man – he must pay it on behalf of himself and on behalf of his dependants, from the young to the old, the free and the slave, the male and the female. [He should pay] one sa`a of dates, or one sa`a of wheat, or one sa`a of barley – and the best of that is dates. One sa`a is four mudds, and one mudd is the weight of two hundred and ninety-two and a half silver coins. That is one thousand and one hundred and seventy silver coins in Iraq. There is no problem paying its value in silver or in paper. There is no problem with a person paying on his behalf and on behalf of his dependants to one person [who needs it]. It is not permissible to pay two people what can only suffice one person. There is no problem with paying the fitr from the first of the month of Ramadan till its end. It is a zakat until he prays on Eid. If he gives it after the prayer, then it is a sadaqa. The best time [to give it] is the last day of the month of Ramadan. Whoever has a Muslim or dhimmi slave should pay the fitr on his behalf. Whoever gives birth to a newborn on the day of Fitr before the zawal should pay the fitr on his behalf; but if he is born after the zawal, then there is no fitr incumbent upon him. It is the same if a man converts to Islam before the zawal and afterward.
والحاج على ثلاثة أوجه: قارن، ومفرد، ومتمتع بالعمرة إلى الحج، ولا يجوز لاهل مكة وحاضريها التمتع بالعمرة إلى الحج، وليس لهم إلا القران والافراد، لقول الله عز وجل: (ذلك لمن لم يكن أهله حاضرى المسجد الحرام) (1) وحد حاضري المسجد الحرام أهل المكة وحواليها على ثمانية وأربعين ميلا، ومن كان خارجا عن هذا الحد فلا يحج إلا متمتعا بالعمرة إلى الحج ولا يقبل الله غيره، وينبغي أن يكون الاحرام من العقيق، وأوله من المسلح (2)، وأوسطه غمرة (3)، وآخره ذات عرق (4)، وأوله أفضل، فإن رسول الله (صلى الله عليه وآله) وقت لاهل العراق العقيق، ووقت لاهل الطائف قرن المنازل، ووقت لاهل اليمن يلملم، ووقت لاهل الشام المهيعة وهي الجحفة، ووقت لاهل المدينة ذا الحليفة وهو مسجد الشجرة، ولا يجوز الاحرام قبل بلوغ الميقات، ولا يجوز تأخيره عن الميقات إلا لعلة أو تقية.
There are three types of Hajj pilgrims: a qarin (one who performs `Umra and Hajj at the same time), a mufrad (one who only performs Hajj), and a mutamati` bil `umra ilal Hajj (one who performs `Umra, then takes a break, and then performs Hajj). It is not permissible for the people of Mecca and its surrounding areas to do the mut`a of Hajj. They can only perform the qarin and the ifrad, as Allah says, “This is for those whose family is not in the sacred precincts of the Sanctified Mosque.” (2:196) The perimeter of the sacred precincts of the Sanctified House includes the people of Mecca and its forty-eight Roman mile radius. Whoever is outside of this perimeter does not perform Hajj except that he does the mut`a of `Umra to the Hajj – and Allah does not accept other than that. Ihram should be gowned in `Aqiq – its beginning is in Muslih (in Medina), its middle is in Ghumra (on the road to Mecca), and its end is in `Arq (between Najd and Tihama) – and its beginning is best, for the Messenger of Allah (s) assigned `Aqiq to the people of Iraq, Qarn al-Manazil to the people of Ta’if, Yalamlam to the people of Yemen, al-Mahi`a – which is Juhfa – to the people of the Levant, and Dhul Halifa – Masjid al-Shajara – to the people of Medina. It is not permissible to gown the ihram before reaching al-Miqat, nor is it permissible to delay it passed al-Miqat except for a legitimate reason.
وفرائض الحج سبعة: الاحرام، والتلبيات الاربع، وهي: لبيك اللهم لبيك، لبيك لا شريك لك لبيك، إن الحمد والنعمة لك والملك، لا شريك لك لبيك، وغير ذلك من التلبية سنة، وينبغي للملبي أن يكثر من قوله: " لبيك ذا المعارج لبيك " فإنها تلبية النبي (صلى الله عليه وآله)، والطواف بالبيت فريضة، والركعتان عند مقام إبراهيم (عليه السلام) فريضة، والسعي بين الصفا والمروة فريضة، والوقوت بعرفة فريضة، والوقوف بالمشعر فريضة، وهدي التمتع فريضة، وما سوى ذلك من مناسك الحج سنة،
The obligations of Hajj are seven: (1) ihram, (2) the four talbiyat – which are labbayk Allahumma labbayk, labbayka la shareeka laka labbark, innal hamda wan-ni`mata laka wal mulk, la sharika lak labbayk (I am at Your service, O Allah, I am at Your service. I am at Your service, You have no partners, I am at Your service. Surely, the praise, blessing, and kingdom is Yours. You have no partners. I am at Your service). Other forms of talbiya are from the sunna. The one performing talbiya should frequently say labbayka dhil ma`arij labbayk (I am at Your service, Lord of Pathways of Ascent), for that is the talbiyya of the Prophet (s). (3) Making circuits (tawaf) around the House is obligatory. (4) Praying two units at the maqam of Ibrahim (as) is obligatory. (5) The sa`i between Safa and Marwa is obligatory. (6) Standing at `Arafa is obligatory. (7) The hadi al-tamattu` is obligatory. Every other rite of Hajj is a sunna.
