Chapter on the Inheritance of the Captive

715. hadíth

5675 - رَوَى اَلْحَسَنُ بْنُ مَحْبُوبٍ عَنِ اِبْنِ مِهْزَمٍ عَنْ طَلْحَةَ بْنِ زَيْدٍ قَالَ قَالَ أَبُو عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ : "لاَ يُوَرَّثُ اَلْحَمِيلُ إِلاَّ بِبَيِّنَةٍ" قَالَ "وَ اَلْحَمِيلُ هُوَ اَلَّذِي تَأْتِي بِهِ اَلْمَرْأَةُ حُبْلَى قَدْ سُبِيَتْ وَ هِيَ حُبْلَى فَيَعْرِفُهُ بِذَلِكَ بَعْدُ أَبُوهُ أَوْ أَخُوهُ".

Hadith.5675 - Al-Hasan ibn Mahbub narrated from Ibn Mihzam, from Talhah ibn Zayd, who said that Abu Abdullah (as) said: "Child in the womb (hamil) will not inherit except with clear evidence." Imam (as) explained: "The hamil is the child carried by a pregnant woman who was captured while pregnant, and later the father or the brother recognizes the child as theirs."
