781. hadíth Majlisī: صحيح

مُحَمَّدُ بْنُ يَحْيَى عَنِ الْعَمْرَكِيِّ بْنِ عَلِيٍّ عَنْ عَلِيِّ بْنِ جَعْفَرٍ عَنْ أَخِيهِ أَبِي الْحَسَنِ الْأَوَّلِ ( عليه السلام ) قَالَ لَا يَحِلُّ أَكْلُ الْجِرِّيِّ وَ لَا السُّلَحْفَاةِ وَ لَا السَّرَطَانِ قَالَ وَ سَأَلْتُهُ عَنِ اللَّحْمِ الَّذِي يَكُونُ فِي أَصْدَافِ الْبَحْرِ وَ الْفُرَاتِ أَ يُؤْكَلُ فَقَالَ ذَاكَ لَحْمُ الضَّفَادِعِ لَا يَحِلُّ أَكْلُهُ .

11. Muhammad ibn Yahya has narrated from al-‘Amrakiy from Ali ibn Ja‘far from his brother abu al-Hassan (a.s.), who has said the following: “Abu al-Hassan (a.s.), has said, ‘It is not lawful to use eel, turtle and crab for food.’ I then asked him (the Imam) about the shellfish of the ocean and al-Furat: if they could be used for food. He (the Imam) said, ‘That is the flesh of frogs and it is not lawful to use it for food.’”

782. hadíth Majlisī: ضعيف على المشهور

الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ مُعَلَّى بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ عَلِيٍّ الْهَمَذَانِيِّ عَنْ سَمَاعَةَ بْنِ مِهْرَانَ عَنِ الْكَلْبِيِّ النَّسَّابَةِ قَالَ سَأَلْتُ أَبَا عَبْدِ اللَّهِ ( عليه السلام ) عَنِ الْجِرِّيِّ فَقَالَ إِنَّ اللَّهَ عَزَّ وَ جَلَّ مَسَخَ طَائِفَةً مِنْ بَنِي إِسْرَائِيلَ فَمَا أَخَذَ مِنْهُمُ الْبَحْرَ فَهُوَ الْجِرِّيُّ وَ الزِّمِّيرُ وَ الْمَارْمَاهِي وَ مَا سِوَى ذَلِكَ وَ مَا أَخَذَ مِنْهُمُ الْبَرَّ فَالْقِرَدَةُ وَ الْخَنَازِيرُ وَ الْوَبْرُ وَ الْوَرَلُ وَ مَا سِوَى ذَلِكَ .

12. Al-Husayn from Muhammad has narrated from Mu‘alla’ ibn Muhammad from Muhammad ibn Ali al-Hamadaniy from Sama‘ah ibn Mehran from al-Kalbiy al-Nassabah who has said the following: “I once asked abu ‘Abd Allah (a.s.), about eel. He (the Imam) said, ‘Allah, most Majestic, most Glorious, metamorphosed a group of banu Israelites, those of them who went to the sea are eels, al-Zimir and al-Mar Mahi and others, and those who remained on land are apes, pigs, wild cats and lizards and others.’”

783. hadíth Majlisī: مجهول

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ صَالِحِ بْنِ السِّنْدِيِّ عَنْ يُونُسَ قَالَ كَتَبْتُ إِلَى الرِّضَا ( عليه السلام ) السَّمَكُ لَا يَكُونُ لَهُ قِشْرٌ أَ يُؤْكَلُ فَقَالَ إِنَّ مِنَ السَّمَكِ مَا يَكُونُ لَهُ زَعَارَّةٌ فَيَحْتَكُّ بِكُلِّ شَيْ‏ءٍ فَتَذْهَبُ قُشُورُهُ وَ لَكِنْ إِذَا اخْتَلَفَ طَرَفَاهُ يَعْنِي ذَنَبَهُ وَ رَأْسَهُ فَكُلْهُ .

13. Ali ibn Ibrahim has narrated from his father from Salih al-Sindiy from Yunus who has said the following: “I once wrote to abu al-Hassan, al-Rida’ (a.s.), and asked if fish which has no scales can be used for food. He (the Imam) said, ‘Of fish there are those which have bad manners and they rub against everything and its scales go away, but if its two ends are different, its tail and head, then you can use it for food.’”

Locusts

784. hadíth Majlisī: ضعيف

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ هَارُونَ بْنِ مُسْلِمٍ عَنْ مَسْعَدَةَ بْنِ صَدَقَةَ قَالَ سُئِلَ أَبُو عَبْدِ اللَّهِ ( عليه السلام ) عَنْ أَكْلِ الْجَرَادِ فَقَالَ لَا بَأْسَ بِأَكْلِهِ ثُمَّ قَالَ ( عليه السلام ) إِنَّهُ نَثْرَةٌ مِنْ حُوتٍ فِي الْبَحْرِ ثُمَّ قَالَ إِنَّ عَلِيّاً ( عليه السلام ) قَالَ إِنَّ السَّمَكَ وَ الْجَرَادَ إِذَا خَرَجَ مِنَ الْمَاءِ فَهُوَ ذَكِيٌّ وَ الْأَرْضُ لِلْجَرَادِ مَصِيدَةٌ وَ لِلسَّمَكِ قَدْ يَكُونُ أَيْضاً .

1. Ali ibn Ibrahim has narrated (from his father) from Harun ibn Muslim from Mas’adah ibn Sadaqah who has said the following: “Once abu ‘ Abd Allah (a.s.), was asked about using locusts for food. He (the Imam) said, ‘It is not unlawful . 5 He (the Imam) then said, ‘Locusts are of the small pieces of fish in the ocean . 5 He (the Imam) then said that Ali (a.s.), has said, ‘Locust and fish on being taken out of the water are clean and slaughtered properly. The land is the hunting place of locusts and it can happen in the case of fish also ."

785. hadíth Majlisī: مجهول

عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ أَبِي عَبْدِ اللَّهِ عَنْ أَبِيهِ عَنْ عَوْنِ بْنِ جَرِيرٍ عَنْ عَمْرِو بْنِ هَارُونَ الثَّقَفِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ قَالَ أَمِيرُ الْمُؤْمِنِينَ ( عليه السلام ) الْجَرَادُ ذَكِيٌّ فَكُلْهُ فَأَمَّا مَا هَلَكَ فِي الْبَحْرِ فَلَا تَأْكُلْهُ .

2. A number of our people have narrated from Ahmad ibn abu ‘Abd Allah, from his father from ‘Awn ibn Jarir, from ‘Amr ibn Harun al-Thaqafiy who has said the following: “Abu ‘Abd Allah (a.s.), has stated this Hadith. ’Amir al-Mu 5 minin has said, ‘Al-Jarad (locust) is clean and slaughtered, you can use it for food, however, do not use for food whatever dies in water ."

786. hadíth Majlisī: صحيح

مُحَمَّدُ بْنُ يَحْيَى عَنِ الْعَمْرَكِيِّ بْنِ عَلِيٍّ عَنْ عَلِيِّ بْنِ جَعْفَرٍ عَنْ أَخِيهِ أَبِي الْحَسَنِ ( عليه السلام ) قَالَ سَأَلْتُهُ عَنِ الْجَرَادِ نُصِيبُهُ مَيِّتاً فِي الصَّحْرَاءِ أَوْ فِي الْمَاءِ أَ يُؤْكَلُ فَقَالَ لَا تَأْكُلْهُقَالَ وَ سَأَلْتُهُ ( عليه السلام ) عَنِ الدَّبَا مِنَ الْجَرَادِ أَ يُؤْكَلُ قَالَ لَا حَتَّى يَسْتَقِلَّ بِالطَّيَرَانِ .

3. Muhammad ibn Yahya has narrated from al-‘Amrakiy from Ali ibn Ja‘far from his brother, (abu al-Hassan (a.s.) ) who has said the following: “I once asked abu al-Hassan (a.s.), about al-Jarad (locust) that we find dead in the wilderness or in water; if it can be used for food. He (the Imam) said, ‘Do not use them for food . 5 I then asked him (the Imam) about al-Daba’, which is a kind of al-Jarad, if it can be used for food . 5 He (the Imam) said, ‘No, until it is independent in flying ."

Hunting Domestic Birds

787. hadíth Majlisī: صحيح

عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ أَبِي عَبْدِ اللَّهِ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ قَالَ سَأَلْتُ أَبَا الْحَسَنِ الرِّضَا ( عليه السلام ) عَنْ رَجُلٍ يَصِيدُ الطَّيْرَ يُسَاوِي دَرَاهِمَ كَثِيرَةً وَ هُوَ مُسْتَوِي الْجَنَاحَيْنِ وَ يَعْرِفُ صَاحِبَهُ أَوْ يَجِيئُهُ فَيَطْلُبُهُ مَنْ لَا يَتَّهِمُهُ قَالَ لَا يَحِلُّ لَهُ إِمْسَاكُهُ يَرُدُّهُ عَلَيْهِ فَقُلْتُ لَهُ فَإِنْ هُوَ صَادَ مَا هُوَ مَالِكٌ بِجَنَاحَيْهِ لَا يَعْرِفُ لَهُ طَالِباً قَالَ هُوَ لَهُ .

1. A number of our people have narrated from Ahmad ibn abu ‘Abd Allah from Ahmad ibn Muhammad from ibn abu Nasr who has said the following: “I once asked al-Rida 5 (a.s.), about the case of a man who hunts a bird which is worth a large amount of dirham and it has leveled wings. He knows the owner of the bird or that he comes to ask about the bird but does not accuse him. He (the Imam) said, ‘It is not lawful for him to keep. He must return it to him.’ I then asked, ‘What happens if he hunts that which has control over its wings and no one asking for it is known ? 5 He (the Imam) said, ‘It becomes his property. 5 ”

788. hadíth Majlisī: مرسل

عَنْهُ عَنِ ابْنِ فَضَّالٍ عَنِ ابْنِ بُكَيْرٍ عَمَّنْ رَوَاهُ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ إِذَا مَلَكَ الطَّائِرُ جَنَاحَهُ فَهُوَ لِمَنْ أَخَذَهُ .

2. It is narrated from the narrator of the previous Hadith from ibn Faddal from ibn Bukayr from those who narrated to him who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘If a bird has full control over its wings (is able to fly) it then belongs to whoever catches it . 555

789. hadíth Majlisī: مجهول

عَنْهُ عَنِ ابْنِ فَضَّالٍ عَنْ مُحَمَّدِ بْنِ الْفُضَيْلِ قَالَ سَأَلْتُ أَبَا الْحَسَنِ ( عليه السلام ) عَنْ صَيْدِ الْحَمَامَةِ تُسَاوِي نِصْفَ دِرْهَمٍ أَوْ دِرْهَماً فَقَالَ إِذَا عَرَفْتَ صَاحِبَهُ فَرُدَّهُ عَلَيْهِ وَ إِنْ لَمْ تَعْرِفْ صَاحِبَهُ وَ كَانَ مُسْتَوِيَ الْجَنَاحَيْنِ يَطِيرُ بِهِمَا فَهُوَ لَكَ .

3. It is narrated from the narrator of the previous Hadith from ibn Faddal from Muhammad ibn al-Fudayl who has said the following: “I once asked abu al-Hassan (a.s.), about hunting pigeons worth one-half of a dirham or one dirham. He (the Imam) said, ‘If you know its owner return it to him; but if you do not know its owner and its wings are complete with both of which it can fly then it is yours . 555

790. hadíth Majlisī: مجهول

وَ عَنْهُ عَنِ ابْنِ فَضَّالٍ عَنْ عُبَيْدِ بْنِ حَفْصِ بْنِ قُرْطٍ عَنْ إِسْمَاعِيلَ بْنِ جَابِرٍ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ قُلْتُ لَهُ جُعِلْتُ فِدَاكَ الطَّيْرُ يَقَعُ عَلَى الدَّارِ فَيُؤْخَذُ أَ حَلَالٌ هُوَ أَمْ حَرَامٌ لِمَنْ أَخَذَهُ فَقَالَ يَا إِسْمَاعِيلُ عَافٍ أَمْ غَيْرُ عَافٍ قَالَ قُلْتُ جُعِلْتُ فِدَاكَ وَ مَا الْعَافِي قَالَ الْمُسْتَوِي جَنَاحَاهُ الْمَالِكُ جَنَاحَيْهِ يَذْهَبُ حَيْثُ شَاءَ قَالَ هُوَ لِمَنْ أَخَذَهُ حَلَالٌ .

4. It is narrated from the narrator of the previous Hadith from ibn Faddal from ‘Ubayd ibn Fiafs ibn al-Qurt from ’Isma‘il ibn Jabir who has said the following: “I once said to abu ‘Abd Allah (a.s.), I pray to Allah to keep my soul in service for your cause, if a bird is trapped in the house and it is taken, is taking it lawful or unlawful. He (the Imam) asked, ‘O ’Isma‘il is it healthy or it is not healthy and free ? 5 I then asked, ‘I pray to Allah to keep my soul in service for your cause, what is healthy ? 5 He (the Imam) said, ‘It is one with complete wings with full control on them and is able to fly wherever it wants . 5 He (the Imam) said, ‘Such ones belong to whoever catches them . 555
