A Marriage and Divorce or Death before or after the Consummation of Marriage then Marries Her Mother or Daughter
3- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَحَدِهِمَا (عَلَيْهِما السَّلام) قَالَ سَأَلْتُهُ عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً فَنَظَرَ إِلَى رَأْسِهَا وَإِلَى بَعْضِ جَسَدِهَا أَيَتَزَوَّجُ ابْنَتَهَا فَقَالَ لا إِذَا رَأَى مِنْهَا مَا يَحْرُمُ عَلَى غَيْرِهِ فَلَيْسَ لَهُ أَنْ يَتَزَوَّجُ ابْنَتَهَا.
3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has said the following: “I once asked one of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhim al-Salam, about the case of a man who married a woman and looks at her head and a few places of her body; if he could marry her daughter. He (the Imam) said, ‘No, he cannot do so when he has seen what is unlawful for people other than him to look at. It is not lawful for him to marry her daughter.’”
4- أَبُو عَلِيٍّ الأشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ وَمُحَمَّدُ بْنُ إِسْمَاعِيلَ عَنِ الْفَضْلِ بْنِ شَاذَانَ عَنْ صَفْوَانَ بْنِ يَحْيَى عَنْ مَنْصُورِ بْنِ حَازِمٍ قَالَ كُنْتُ عِنْدَ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فَأَتَاهُ رَجُلٌ فَسَأَلَهُ عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً فَمَاتَتْ قَبْلَ أَنْ يَدْخُلَ بِهَا أَيَتَزَوَّجُ بِأُمِّهَا فَقَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَدْ فَعَلَهُ رَجُلٌ مِنَّا فَلَمْ نَرَ بِهِ بَأْساً فَقُلْتُ جُعِلْتُ فِدَاكَ مَا تَفْخَرُ الشِّيعَةُ إِلا بِقَضَاءِ عَلِيٍّ (عَلَيْهِ السَّلام) فِي هَذِهِ الشَّمْخِيَّةِ الَّتِي أَفْتَاهَا ابْنُ مَسْعُودٍ أَنَّهُ لا بَأْسَ بِذَلِكَ ثُمَّ أَتَى عَلِيّاً (عَلَيْهِ السَّلام) فَسَأَلَهُ فَقَالَ لَهُ عَلِيٌّ (عَلَيْهِ السَّلام) مِنْ أَيْنَ أَخَذْتَهَا فَقَالَ مِنْ قَوْلِ اللهِ عَزَّ وَجَلَّ وَرَبائِبُكُمُ اللاتِي فِي حُجُورِكُمْ مِنْ نِسائِكُمُ اللاتِي دَخَلْتُمْ بِهِنَّ فَإِنْ لَمْ تَكُونُوا دَخَلْتُمْ بِهِنَّ فَلا جُناحَ عَلَيْكُمْ فَقَالَ عَلِيٌّ (عَلَيْهِ السَّلام) إِنَّ هَذِهِ مُسْتَثْنَاةٌ وَهَذِهِ مُرْسَلَةٌ وَأُمَّهاتُ نِسائِكُمْ فَقَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) لِلرَّجُلِ أَمَا تَسْمَعُ مَا يَرْوِي هَذَا عَنْ عَلِيٍّ (عَلَيْهِ السَّلام) فَلَمَّا قُمْتُ نَدِمْتُ وَقُلْتُ أَيَّ شَيْءٍ صَنَعْتُ يَقُولُ هُوَ قَدْ فَعَلَهُ رَجُلٌ مِنَّا فَلَمْ نَرَ بِهِ بَأْساً وَأَقُولُ أَنَا قَضَى عَلِيٌّ (عَلَيْهِ السَّلام) فِيهَا فَلَقِيتُهُ بَعْدَ ذَلِكَ فَقُلْتُ جُعِلْتُ فِدَاكَ مَسْأَلَةُ الرَّجُلِ إِنَّمَا كَانَ الَّذِي قُلْتُ يَقُولُ كَانَ زَلَّةً مِنِّي فَمَا تَقُولُ فِيهَا فَقَالَ يَا شَيْخُ تُخْبِرُنِي أَنَّ عَلِيّاً (عَلَيْهِ السَّلام) قَضَى بِهَا وَتَسْأَلُنِي مَا تَقُولُ فِيهَا.
4. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar and Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan from Safwan ibn Yahya from Mansur ibn Hazim who has said the following: “Once I was with abu ‘Abd Allah (a.s.), when a man came and asked about the case of a man who married a woman but she died before going to bed with her; if he could marry her mother. Abu ‘Abd Allah (a.s.), said, ‘A man from us had done so, thus I do not see it as unlawful.’ I then said, ‘I pray to Allah to keep my soul in service for your cause, al-Shi’ah are only proud of the judgment of Ali (a.s.), on the issue of al-Shamakhiyah about which ibn Mas‘ud had given a Fatwa that said, “It is not harmful”, then he went to Ali (a.s.), and asked him (the Imam) and Ali (a.s.), asked, “From what source did you take it?” He (ibn Mas‘ud) replied, “I took it from the words of Allah, most Majestic, most Glorious, ‘. . . and those who grow in your care from your women with whom you have gone to bed but if you have not gone to bed with them (their mother) then it is not harmful for you . . .’ (4:23)” Ali (a.s.), said, “This (the case in this verse) is an exception (from woman married in general with or without sexual intercourse) and this one is free of such exceptions (that is she is divorced and there is no question about sexual intercourse) and ‘the mother of your women’ in the above verse.’” Abu ‘Abd Allah (a.s.), said to the man, ‘Do you hear what this man is narrating from Ali (a.s.) .’ When I stood up I regretted and said to myself, ‘What did I do?’ He (the Imam) said, ‘A man from us has done so, thus I do not see it as harmful,’ and I say, ‘Ali (a.s.), judged the issue.’ I then met him (the Imam) afterwards and said, ‘I pray to Allah to keep my soul in service for your cause, about the question of that man, my saying that “he says so and so” was a slip from me. What do you say about it?’ He (the Imam) said, ‘O Shaykh, when you narrate to me that Ali (a.s.), judged the issue then why do you ask me about what I say on the case?”’ (One must consult fatwa about the above Hadith)
5- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ خَالِدِ بْنِ جَرِيرٍ عَنْ أَبِي الرَّبِيعِ قَالَ سُئِلَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً فَمَكَثَ أَيَّاماً مَعَهَا لا يَسْتَطِيعُهَا غَيْرَ أَنَّهُ قَدْ رَأَى مِنْهَا مَا يَحْرُمُ عَلَى غَيْرِهِ ثُمَّ يُطَلِّقُهَا أَيَصْلُحُ لَهُ أَنْ يَتَزَوَّجَ ابْنَتَهَا فَقَالَ أَيَصْلُحُ لَهُ وَقَدْ رَأَى مِنْ أُمِّهَا مَا قَدْ رَأَى.
5. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from Khalid ibn Jarir from abu al-Rabi‘ who has said the following: “About the case of a man who marries a woman and lives with her for many days, unable to do anything except that he has seen from her what is unlawful for others to see; then he divorces her; if he can marry her daughter. He (the Imam) said, ’How can it be proper for him when he has seen of her mother what he has seen?’”

Marriage with a Woman Divorced Against the Sunnah
1- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ عَنْ عُثْمَانَ بْنِ عِيسَى عَنْ بَعْضِ أَصْحَابِنَا عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) أَنَّهُ قَالَ إِيَّاكُمْ وَذَوَاتِ الأزْوَاجِ الْمُطَلَّقَاتِ عَلَى غَيْرِ السُّنَّةِ قَالَ قُلْتُ لَهُ فَرَجُلٌ طَلَّقَ امْرَأَتَهُ مِنْ هَؤُلاءِ وَلِي بِهَا حَاجَةٌ قَالَ فَتَلْقَاهُ بَعْدَ مَا طَلَّقَهَا وَانْقَضَتْ عِدَّتُهَا عِنْدَ صَاحِبِهَا فَتَقُولُ لَهُ طَلَّقْتَ فُلانَةَ فَإِذَا قَالَ نَعَمْ فَقَدْ صَارَ تَطْلِيقَةً عَلَى طُهْرٍ فَدَعْهَا مِنْ حِينَ طَلَّقَهَا تِلْكَ التَّطْلِيقَةَ حَتَّى تَنْقَضِيَ عِدَّتُهَا ثُمَّ تَزَوَّجْهَا فَقَدْ صَارَتْ تَطْلِيقَةً بَائِنَةً.
1. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from ‘Uthman ibn ‘Isa from certain persons of our people who have said the following: “Abu ‘ Abd Allah (a.s.), has said, ‘You must remain on your guard in the case of married women who are divorced against the Sunnah.’ I asked him (the Imam) that a man has divorced his wife and I am interested. He (the Imam) said, ‘Meet him after he divorces her and waiting period is complete with him then ask him, ‘Have you divorced so and so?’ If he said, ‘Yes, I have divorced her’, this is one divorce during a menses free period. From the time he has divorced her until waiting period is complete then you can marry and divorce has made them complete strangers to each other.’”
2- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ عِيسَى عَنِ الْحُسَيْنِ بْنِ سَعِيدٍ عَنِ النَّضْرِ بْنِ سُوَيْدٍ عَنْ مُحَمَّدِ بْنِ أَبِي حَمْزَةَ عَنْ شُعَيْبٍ الْحَدَّادِ قَالَ قُلْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) رَجُلٌ مِنْ مَوَالِيكَ يُقْرِئُكَ السَّلامَ وَقَدْ أَرَادَ أَنْ يَتَزَوَّجَ امْرَأَةً قَدْ وَافَقَتْهُ وَأَعْجَبَهُ بَعْضُ شَأْنِهَا وَقَدْ كَانَ لَهَا زَوْجٌ فَطَلَّقَهَا ثَلاثاً عَلَى غَيْرِ السُّنَّةِ وَقَدْ كَرِهَ أَنْ يُقْدِمَ عَلَى تَزْوِيجِهَا حَتَّى يَسْتَأْمِرَكَ فَتَكُونَ أَنْتَ تَأْمُرُهُ فَقَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) هُوَ الْفَرْجُ وَأَمْرُ الْفَرْجِ شَدِيدٌ وَمِنْهُ يَكُونُ الْوَلَدُ وَنَحْنُ نَحْتَاطُ فَلا يَتَزَوَّجْهَا.
2. A number of our people have narrated from Ahmad ibn Muhammad ibn ‘Isa from al-Husayn ibn Sa‘id from al-Nadr ibn Suwayd from Muhammad ibn abu Hamzah from Shu’ayb al-Hadad who has said the following: “I once said to abu ‘Abd Allah (a.s.), ‘One of your followers offers greetings of peace to you and he wants to marry a woman who has agreed and he likes her due to certain matters about her and she has a husband who has divorced her three times on non-Sunnah basis. He dislikes marrying her without your instruction so you command him to do so. Abu ‘Abd Allah (a.s.), said, ‘It is an issue of marriage and the matter of marriage is severe because from marriage are children and we maintain precaution, so he must not marry her.’”
3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَفْصِ بْنِ الْبَخْتَرِيِّ عَنْ إِسْحَاقَ بْنِ عَمَّارٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلاثاً فَأَرَادَ رَجُلٌ أَنْ يَتَزَوَّجَهَا كَيْفَ يَصْنَعُ قَالَ يَدَعُهَا حَتَّى تَحِيضَ وَتَطْهُرَ ثُمَّ يَأْتِيهِ وَمَعَهُ رَجُلانِ شَاهِدَانِ فَيَقُولُ أَطَلَّقْتَ فُلانَةَ فَإِذَا قَالَ نَعَمْ تَرَكَهَا ثَلاثَةَ أَشْهُرٍ ثُمَّ خَطَبَهَا إِلَى نَفْسِهَا.
3. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hafs ibn al-Bakhtariy from Ishaq ibn ‘Ammar who has said the following: “About the case of a man who divorces his wife three times and then another man wants to marry her and about what he must do, abu ‘Abd Allah (a.s.), has said, ‘He must wait until she experiences one cycle of menses; then he must go to the man who has divorced her and ask him in the presence of two people, ‘Have you divorced so and so?’ If he said, ‘Yes, I have divorced her, then he must leave her alone for three months, then propose to her for marriage.’”
4- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ مُوسَى بْنِ بَكْرٍ عَنْ عَلِيِّ بْنِ حَنْظَلَةَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ إِيَّاكَ وَالْمُطَلَّقَاتِ ثَلاثاً فِي مَجْلِسٍ فَإِنَّهُنَّ ذَوَاتُ أَزْوَاجٍ.
4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Musa ibn Bakr from Ali ibn Hanzalah who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘Beware of the case of a woman divorced three times in one meeting; they are married women.”

Marriage with a Woman and Her Maternal or Paternal Aunt
1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ عِيسَى عَنِ الْحَسَنِ بْنِ عَلِيِّ بْنِ فَضَّالٍ عَنِ ابْنِ بُكَيْرٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ لا تُزَوَّجُ ابْنَةُ الأخِ وَلا ابْنَةُ الأخْتِ عَلَى الْعَمَّةِ وَلا عَلَى الْخَالَةِ إِلا بِإِذْنِهِمَا وَتُزَوَّجُ الْعَمَّةُ وَالْخَالَةُ عَلَى ابْنَةِ الأخِ وَابْنَةِ الأخْتِ بِغَيْرِ إِذْنِهِمَا.
1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from al-Hassan ibn Ali ibn Faddal from ibn Bukayr from Muhammad ibn Muslim who has said the following: “Abu Ja‘far (a.s.), has said, ‘You must not marry a daughter of a brother or daughter of a sister as a second wife, the first being her paternal or maternal aunt without their permission and you must not marry a paternal or maternal aunt as a second wife, the first being a daughter of her brother or a daughter of her sister, without their permission.’”
2- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنِ الْحَسَنِ بْنِ مَحْبُوبٍ عَنْ عَلِيِّ بْنِ رِئَابٍ عَنْ أَبِي عُبَيْدَةَ الْحَذَّاءِ قَالَ سَمِعْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ لا تُنْكَحُ الْمَرْأَةُ عَلَى عَمَّتِهَا وَلا خَالَتِهَا إِلا بِإِذْنِ الْعَمَّةِ وَالْخَالَةِ.
2. A number of our people have narrated from Sahl ibn Ziyad from al-Hassan ibn Mahbub from ibn Ri’ab from abu ‘Ubaydah al- Hadhdha’ who has said the following: “I once heard abu Ja‘far (a.s.), saying, ‘You must not marry a woman as a second wife, the first being her paternal or maternal aunt, without her permission.’”

Legalizing a Divorced Woman to Her Husband
1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادِ بْنِ عِيسَى عَنْ حَرِيزٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَحَدِهِمَا (عَلَيْهِما السَّلام) قَالَ سَأَلْتُهُ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلاثاً ثُمَّ تَمَتَّعَ فِيهَا رَجُلٌ آخَرُ هَلْ تَحِلُّ لِلأوَّلِ قَالَ لا.
1. Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Hariz from Muhammad ibn Muslim who has said the following: “I once asked one of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhim al-Salam, about the case of a man who divorced his wife three times; then another man formed Mut‘ah with her if thereafter she can become lawful for him. He (the Imam) said, ‘No, it ( Mut‘ah ) is not enough.’”
