Marriage of one Born out of Wedlock

1401. hadíth Majlisī: حسن

1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادِ بْنِ عِيسَى عَنْ حَرِيزِ بْنِ عَبْدِ اللهِ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ سَأَلْتُهُ عَنِ الْخَبِيثَةِ أَتَزَوَّجُهَا قَالَ لا.

1. Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Hur ibn ‘Abd Allah from Muhammad ibn Muslim who has said the following: “This is concerning my question before abu Ja’far (a.s.), if I can marry the filthy (prostitute). He (the Imam) said, ’No, you cannot do so/”

2- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ مُحَمَّدِ بْنِ أَبِي عُمَيْرٍ عَنْ جَمِيلِ بْنِ دَرَّاجٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَحَدِهِمَا (عَلَيْهِما السَّلام) فِي الرَّجُلِ يَشْتَرِي الْجَارِيَةَ أَوْ يَتَزَوَّجُهَا لِغَيْرِ رِشْدَةٍ وَيَتَّخِذُهَا لِنَفْسِهِ فَقَالَ إِنْ لَمْ يَخَفِ الْعَيْبَ عَلَى وُلْدِهِ فَلا بَأْسَ.

2. Ali ibn Ibrahim has narrated from his father from Muhammad Ibn Abi ‘Umayr from Jamil ibn Darraj from Muhammad ibn Muslim who has said the following: “One of the two Imam, (abu Ja’far or abu ’Abd Allah), ‘Alayhim al-Salam, about the case of a man who buys a slave-girl or marries her without proper wedlock and keeps her for his own self, he (the Imam) has said, ‘If he is not afraid of the stigma for his children, it is not unlawful.”’

1403. hadíth Majlisī: صحيح

3- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ وَعِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنِ الْحَسَنِ بْنِ مَحْبُوبٍ عَنْ عَبْدِ اللهِ بْنِ سِنَانٍ قَالَ قُلْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) وَلَدُ الزِّنَا يُنْكَحُ قَالَ نَعَمْ وَلا يُطْلَبُ وَلَدُهَا.

3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad Ahmad ibn Muhammad from certain persons of our people from Sahl ibn Ziyad from al-Hassan ibn Mahbub from ‘Abd Allah ibn Sinan who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about marriage with one born out of wedlock. He (the Imam) said, ‘Yes, but her children are not wanted.’”

1404. hadíth Majlisī: صحيح

4- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ سَأَلْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) عَنِ الْخَبِيثَةِ يَتَزَوَّجُهَا الرَّجُلُ قَالَ لا وَقَالَ إِنْ كَانَ لَهُ أَمَةٌ وَطِئَهَا وَلا يَتَّخِذْهَا أُمَّ وَلَدِهِ.

4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has said the following: “I once asked abu Ja’far (a.s.), about the case of a man if he could marry the filthy (prostitute). He (the Imam) said, ‘No, he cannot do so.’ He (the Imam) said, ‘If he has a slave-girl with whom he has gone to bed but she must not be taken as the mother of his children.’” (He must use contraceptives)

1405. hadíth Majlisī: حسن

5- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ مُحَمَّدِ بْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ سُئِلَ عَنِ الرَّجُلِ يَكُونُ لَهُ الْخَادِمُ وَلَدَ زِنًى عَلَيْهِ جُنَاحٌ أَنْ يَطَأَهَا قَالَ لا وَإِنْ تَنَزَّهَ عَنْ ذَلِكَ فَهُوَ أَحَبُّ إِلَيَّ.

5. Ali ibn Ibrahim has narrated from his father from Muhammad Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “Once abu ‘Abd Allah (a.s.), was asked about the case of a man who has a servant born out of wedlock; if he can go to bed with her. He (the Imam) said, ‘No, if he stays clean of that, it is more likeable to me.’”

Detestability of Marriage with Dimwitted and Insane People

1406. hadíth Majlisī: ضعيف على المشهور

1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ النَّوْفَلِيِّ عَنِ السَّكُونِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ قَالَ أَمِيرُ الْمُؤْمِنِينَ (صَلَّى اللهُ عَلَيْهِ وَآلِه) إِيَّاكُمْ وَتَزْوِيجَ الْحَمْقَاءِ فَإِنَّ صُحْبَتَهَا بَلاءٌ وَوُلْدَهَا ضِيَاعٌ.

1. Ali ibn Ibrahim has narrated from his father from af-Nawfafiy from af-Sakuniy who has said the following: “Abu ‘ Abd Allah (a.s.), has said that ’Amir al-Mu’minin has said, ’Beware of marriage with dimwitted ones, living with her is a tragedy and her children are a loss.’”

1407. hadíth Majlisī: مرسل

2- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ أَبِي عَبْدِ اللهِ عَنْ أَبِيهِ عَمَّنْ حَدَّثَهُ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ زَوِّجُوا الأحْمَقَ وَلا تُزَوِّجُوا الْحَمْقَاءَ فَإِنَّ الأحْمَقَ يَنْجُبُ وَالْحَمْقَاءَ لا تَنْجُبُ.

2. A number of our people have narrated from Ahmad ibn abu ‘Abd Allah from his father from those who narrated to him who has said the following: “Abu ’Abd Allah (a.s.), has said, ‘You can give in marriage to a dimwitted man but do not marry a dimwitted woman; a dimwitted man can have children (healthy ones) but a dimwitted woman cannot.”’

1408. hadíth Majlisī: صحيح

3- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ أَبِي أَيُّوبَ الْخَزَّازِ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ سَأَلَهُ بَعْضُ أَصْحَابِنَا عَنِ الرَّجُلِ الْمُسْلِمِ تُعْجِبُهُ الْمَرْأَةُ الْحَسْنَاءُ أَيَصْلُحُ لَهُ أَنْ يَتَزَوَّجَهَا وَهِيَ مَجْنُونَةٌ قَالَ لا وَلَكِنْ إِنْ كَانَتْ عِنْدَهُ أَمَةٌ مَجْنُونَةٌ فَلا بَأْسَ بِأَنْ يَطَأَهَا وَلا يَطْلُبَ وَلَدَهَا.

3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub abu Ayyub al-Khazzaz from Muhammad ibn Muslim who has said the following: “Certain persons of our people once asked abu Ja’far (a.s.), about the case of a Muslim man who likes a beautiful woman; if he can marry her and she is insane. He (the Imam) said, ’No, however, if he has an insane slave-girl he can go to bed with her but must not seek her children (he must use contraceptives).”’

1409. hadíth Majlisī: ضعيف

1- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ عَنْ دَاوُدَ بْنِ سِرْحَانَ عَنْ زُرَارَةَ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ قَوْلِ اللهِ عَزَّ وَجَلَّ الزَّانِي لا يَنْكِحُ إِلا زانِيَةً أَوْ مُشْرِكَةً قَالَ هُنَّ نِسَاءٌ مَشْهُورَاتٌ بِالزِّنَا وَرِجَالٌ مَشْهُورُونَ بِالزِّنَا شُهِرُوا وَعُرِفُوا بِهِ وَالنَّاسُ الْيَوْمَ بِذَلِكَ الْمَنْزِلِ فَمَنْ أُقِيمَ عَلَيْهِ حَدُّ الزِّنَا أَوْ مُتَّهَمٌ بِالزِّنَا لَمْ يَنْبَغِ لأحَدٍ أَنْ يُنَاكِحَهُ حَتَّى يَعْرِفَ مِنْهُ التَّوْبَةَ.

1. A number of our people have narrated from Sahl ibn Ziyad from Ahmad ibn Muhammad from ibn abu Nasr from Dawud ibn Sarhan from Zurarah who has said the following: “Once I asked abu ‘ Abd Allah (a.s.), about the meaning of the words of Allah, most Majestic, most Glorious. ‘A prostitute man cannot marry but a prostitute woman or a pagan.’ (24:4) He (the Imam) said, ‘They were well-known prostitute females, and males. Today people who are convicted for fornication and punished (by the qualified court) are of the same status. No one must marry them unless it is known that they have repented.’”

1410. hadíth Majlisī: مجهول

2- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ عَنْ مُحَمَّدِ بْنِ الْفُضَيْلِ عَنْ أَبِي الصَّبَّاحِ الْكِنَانِيِّ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ قَوْلِ اللهِ عَزَّ وَجَلَّ الزَّانِي لا يَنْكِحُ إِلا زانِيَةً أَوْ مُشْرِكَةً فَقَالَ كُنَّ نِسْوَةٌ مَشْهُورَاتٌ بِالزِّنَا وَرِجَالٌ مَشْهُورُونَ بِالزِّنَا قَدْ عُرِفُوا بِذَلِكَ وَالنَّاسُ الْيَوْمَ بِتِلْكَ الْمَنْزِلَةِ فَمَنْ أُقِيمَ عَلَيْهِ حَدُّ الزِّنَا أَوْ شُهِرَ بِهِ لَمْ يَنْبَغِ لأحَدٍ أَنْ يُنَاكِحَهُ حَتَّى يَعْرِفَ مِنْهُ التَّوْبَةَ.

2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ‘Isma’il from Muhammad ibn al-Fudayl from abu al-Sabbah al-Kinaniy who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the word of Allah, most Majestic, most Glorious, ‘A prostitute man cannot marry but a prostitute woman or a pagan.’ (24:4) He (the Imam) said, ‘They were well-known prostitute females and males. Today people who are convicted for fornication and punished (by the qualified court) are of the same status. No one must marry them unless it is known that they have repented.’”
